Terms of Service

Welcome to Eclipta. These Terms of Service (“Terms”) govern your use of the Eclipta mobile application (“App”) and any related services. By creating an account or using the App, you agree to be bound by these Terms.

1. MEDICAL & WELLNESS DISCLAIMER

ECLIPTA IS NOT A MEDICAL DEVICE OR A MEDICAL PROVIDER. The App provides a meditation timer, screen time tracking, and wellness statistics. The information provided is for relaxation and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • No Doctor-Patient Relationship: Use of the App does not create a professional relationship.
  • Seek Advice: Always seek the advice of your physician or mental health professional with any questions regarding a medical condition.
  • Emergency: If you are experiencing a health emergency or crisis, contact emergency services (e.g., 911) immediately.

2. ELIGIBILITY & ACCOUNTS

  • Age: You must be at least 13 years of age (or the minimum age of consent in your jurisdiction) to use Eclipta.
  • Registration: You may register via “Sign in with Apple,” Google, or Email. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. DATA & PRIVACY

Your use of the App is also governed by our Privacy Policy. By using Eclipta, you acknowledge that we utilize the Apple HealthKit API and Screen Time (FamilyControls) API to provide core features.

4. SUBSCRIPTIONS AND PAYMENTS

  • Billing: Premium features are handled via Apple In-App Purchases (IAP) and managed through RevenueCat. Apple — for users in the EU/EEA, Apple Distribution International Ltd. (Ireland) — is the merchant of record for all purchases.
  • Refunds: Because Apple is the merchant of record, all refunds are handled by Apple; Eclipta cannot grant, deny, or process refunds. To request one, use Apple’s “Report a Problem” page (reportaproblem.apple.com) or Apple Support. If you are a consumer in the EU/EEA, your statutory 14-day right of withdrawal is exercised through Apple under Apple’s Media Services Terms.
  • Cancellations: Manage or cancel your subscription at any time in iOS Settings → your Apple ID → Subscriptions. Cancelling stops future renewals but does not automatically refund the current period.
  • Pricing: We reserve the right to change our subscription fees at any time with reasonable notice provided via the App or App Store.
  • Statutory rights: Nothing in this section limits any mandatory consumer rights you may have under applicable law.

5. ACCURACY OF STATISTICS

Eclipta aggregates data from your device’s operating system (iOS). We do not guarantee the 100% accuracy of “Screen Time” or “Mindful Minutes” metrics, as these are dependent on Apple’s system-level reporting and background processing.

6. FEEDBACK AND SUGGESTIONS

  • What you send us: You may send suggestions, ideas, feature requests and bug reports through the App or on our public suggestions board. Please do not include confidential information, personal data about other people, or anything you are not free to share.
  • Licence: By sending us a suggestion you grant us a perpetual, worldwide, royalty-free right to use, implement and build on it in Eclipta or any other product, without any obligation to compensate, credit or notify you. You confirm the suggestion is yours to give. Nothing here transfers ownership of anything you have separately protected — but if we ship something similar to your idea, you agree we owe you nothing for it. Many people suggest the same things, and we may already be working on it.
  • Our public board: Our suggestions board is a separate website, opened in your browser. Posts there are public and are not confidential. We may edit, decline, reorder, moderate or remove any post, and we may set or change the status of any item at any time. A status such as "Planned" reflects our current intention, not a promise, a deadline, or a commitment to ship.
  • Acceptable use: Do not post anything unlawful, abusive, hateful, deceptive, infringing, or containing another person's private information, and do not use the board to advertise. We may remove content and block access for anyone who does.

7. ACCOUNT DELETION

In compliance with App Store regulations, you may delete your account at any time within the App’s “Settings” menu. Upon deletion, your data stored on our servers (Supabase) will be permanently erased.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Eclipta and its developers shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App or reliance on its statistics.

9. GOVERNING LAW

These Terms are governed by the laws of Spain, without regard to conflict of law principles. If you are a consumer resident in the European Union, you additionally enjoy any mandatory protections of the consumer law of your country of residence, and disputes may be brought before the courts of that country.
